Post a Picture and DIE!!!!

So, this is going to be a bit of a rant. Just so you’re prepared. It started about a month ago when I came across a picture that really captured the essence of the heroine of my book, The Last Ranger of Sarn. Of course, like almost every piece of art that floats about on the internet, there was no artist signature.

Still, I loved the look and put it on my website. Not as a cover to be released, not as a poster, coffee mug, book marker…absolutely nothing that would make me a penny. I simply put a statement saying what the picture conveyed to me and also asking that if anybody knew the artist, to please let me know. I wanted to buy the pic if possible or at least give the artist credit for doing such a great job.

Yesterday, I get this irate person yelling at me all over facebook and twitter that I had stolen his work and illegally put his image on my webpage. He ordered it taken down…or, I should pay him for having it there. Well, even with his acerbic attitude, I was very tempted to buy the picture. I apologized and started removing it from my website. I even wrote a nice little thing about it on my site where the picture had been explaining I had put it up mistakenly, not with any intention of “stealing” it.

Now, it was a bit late when I started doing it and I had work the next day. I figured I could finish removing it from all of my social media the next day. Oh nooooo… This cheeseball continues the harassment, placing his little attention-seeking rants about how I stole his work and how I was the world’s biggest art thief and so on. He floods my Facebook and Twitter with this nonsense and doesn’t let up for a minute.

Now, I design book covers and I use paid images when I need specific things. Any other pics I use are under Creative Commons license. When attrition is called for, I graciously give it…it’s only fair. I’m not a thief. I’m no more a thief than any of the millions of people that post pictures to their social media pages. But this little twit, has the brass balls to create this huge fuss about it and it had me wondering why.

Then it came to me. He has a total of 8 followers on Twitter. There’s hardly any interaction on Facebook. A handful of connections at LinkedIn. So, despite every effort on his part to act as if he’s a normal person going about his daily life, it seems to me that he’s what’s known as an internet troll. Someone that takes a very small bump and rubs it until it’s the size of Vermont and festering. An attention whore to put it bluntly.

So, take this as a warning. Don’t post pictures. None. Not even the cat with the frown. You might get called out on it. You might wake up with 3 dozen posts on your social media pages about what a terrible human you are. The world will turn against you until you’re just a sad excuse for the person you used to be. And then one day, you’ll open your mail and there it is…poop from the frowny cat. All because you posted a picture.

This is so true… everything you said is factual… you’re a thief and you admit it.
Thank you for being so open about it.
I bet you feel better now don’t you.

I saw what went down yesterday and… I see today is no better.

It must feel pretty bad to wake up to all that grief over your page, but if you could imagine how you’d feel if someone took one of your books–Like Ranger’s of Sarn, maybe. Or one of the cover images, even–and posted it out there for all the world to see with no trace back to you. Maybe they’re not making money out it, it’s a freebie on their website. I’m sure you’d still be pissed at all your effort going to this other person who just went, and I paraphrase, “yep, I’ll have that”.
Then when you confront them, and I bet you wouldn’t be politely asking them to take it down, say they tell you the same things you told this person. “I didn’t know who it belonged to” because they found it somewhere else. Or “I’m not making money off it”, but maybe it’s what draws people to their website instead of yours where they also have stuff you can buy. That’s still revenue to them. Maybe that’s not happening, but how can you be sure? Would you be satisfied with a “I’m sorry, I didn’t know what I was doing was wrong” and a promise to take it down… later?
    I know I wouldn’t.

So maybe this person wasn’t professional in how they went about it, but neither were you in handling it. In truth, you’re still not being professional in the way you’re speaking about this person. It’s right there in the middle of your post and on the front of your website. It’s the first thing people will see when they go to your site and, quite frankly, it’s rather off-putting. I followed you because you’re a fellow indie author, which is why I hesitated to even write this because I must put my email in and I’m a little scared you’ll turn on me for speaking my mind. But at the moment, I’m mostly shocked. I really thought you were a nice person and it saddens me to see evidence to the contrary.

I’m going to close this by saying you could’ve avoided all of what you’ve just gone through by google searching the image in the first place to ask them. That’s how I find who truly owns images. It’s not always easy, but it’s better than having this happen.

Actually I did exactly as you suggested and did a google search under images for my title “The Sweet Taste of Revenge” and it’s the 4th image to appear… not hard…. try an image search for RGUS… lots and lots of images… I’m sure one could find the owner of an image quite quickly.

    • OK, let me clarify this one last time. Had I woke up to something like “Hey Mate, that’s my picture. Can you take it down?” I swear to God, you would have received an apology and I would have taken everything down. I would have started a civilized dialogue and asked to buy your picture. I loved it…which is why it was in so many places. Instead Deane, you jump down my throat with the whole art thief thing, you spam post it all over my FB, Twitter and Google+ accounts. And you continued it unrelentingly. Even at that, my wife and I got every pic down within two days. But that still wasn’t good enough.
If I find an excerpt from my book on someone’s page, I’ll ask them to please put my name there for credit and then THANK THEM for liking it so much that they wanted to put it out for their world to see. You see, as long as they didn’t put the entire book…just as I didn’t put your entire portfolio…I would have no problem with it as long as they linked it back to me. Something I would have wholeheartedly done for you.
You seem to think I’m some kind of evil, twisted monster. I’m actually a very nice person until I’m set upon. And you Deane, came at me like I was the monster. That is why I said you have no people skills. Do you know how many people expressed an interest in your picture to me? Had I been able to put your link up, I guarantee you would have made a few commissions, starting with mine.
And now, you continue to harass me about this. You create an account and write notes as if you’re someone else…dude, that’s sick. I get your point, and I understand where you’re coming from. Maybe you should sit and see my point. Please don’t attack me? You did the attacking, I just continued the battle. As for an apology, that would have come at the start had you approached me like a man instead of some emo 14 year old. You’ll never see that now.
And this is the last time you’ll see any response from me. I will no longer feed the troll so you might as well move on to the next party.

Sad now that even your own followers… “Please don’t attack Me” have turned against you. Your blogs and web pages are in tatters and it still seems you can not read… so for your information regarding laws in your own country.

        “It DOESN’T MATTER…

if you link back to the source and list the photographer’s name
if the picture is not full-sized (only thumbnail size is okay)
        if you did it innocently
if your site is non-commercial and you made no money from the use of the photo
if you didn’t claim the photo was yours
if you’ve added commentary in addition to having the pic in the post
if the picture is embedded and not saved on your server
if you have a disclaimer on your site.
if you immediately take down a pic if someone sends you a DMCA notice (you do have to take it down, but it doesn’t absolve you.)

NONE OF THAT releases you from liability.

You are violating copyright if you have not gotten express PERMISSION from the copyright holder OR are using pics that are public domain, creative commons, etc….”

Thanks “Please don’t attack me”… if he had even said a simple sorry I may have let him use the image for free. I know I didn’t handle it well… but… heat being heat… anyway… as an author his publisher and he should know better… this link explains all… http://roniloren.com/blog/2012/7/20/bloggers-beware-you-can-get-sued-for-using-pics-on-your-blog.html

All that is really required for this to go away is an apology… but then.. they are the hardest things in the world to swallow.
